1. Acceptance of Terms

By downloading, installing, or using CradleLog (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

CradleLog is a baby tracking application that allows parents and caregivers to log feeds, diaper changes, sleep patterns, and other baby-related activities. The App operates entirely on your device and does not require an internet connection or account creation.

3. License Grant

Subject to your compliance with these Terms, CradleLog grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes on devices that you own or control.

You may not:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App, except as permitted by applicable law
• Rent, lease, lend, sell, or sublicense the App
• Use the App for any unlawful purpose or in violation of these Terms

4. Your Data

All data you enter into the App is stored locally on your device. You are solely responsible for:

• Maintaining backups of your data using your device's backup features
• The accuracy of the information you enter
• Protecting access to your device and the data stored on it

CradleLog has no access to your data and cannot recover data that is lost due to device failure, app deletion, or any other cause.

5. Medical Disclaimer

CradleLog is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

The App is designed to help you track and organize information about your baby's daily activities. It does not provide medical advice, and the information logged should not be used as a substitute for professional medical judgment.

Always consult with a qualified healthcare provider regarding any questions or concerns about your child's health. If you believe your child is experiencing a medical emergency, contact emergency services immediately.

6. Intellectual Property

The App, including its design, features, content, and underlying code, is owned by CradleLog and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to use the CradleLog name, logo, or other trademarks.

7. Updates and Changes

We may release updates to the App from time to time. These updates may include bug fixes, new features, or changes to existing features. We reserve the right to modify, suspend, or discontinue the App at any time without notice.

8. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CRADLELOG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP, IF ANY.

10. Indemnification

You agree to indemnify and hold harmless CradleLog and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App or your violation of these Terms.

11. Termination

You may stop using the App at any time by deleting it from your device. We reserve the right to terminate or suspend your license to use the App at any time, for any reason, without notice.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in San Francisco, California.

13. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the “Last updated” date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
